Terms of Service

1. Acceptance of Terms

By accessing or using MonstaReel (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MonstaReel is an AI-powered short-form video creation platform that generates scripts, voiceovers, captions, and video reels based on user-provided topics. Generated videos are delivered as downloadable MP4 files.

3. Accounts and Credits

• You must create an account to use the Service. You are responsible for maintaining the security of your account.
• Paid plans include separate stock reel credits (library + Pexels) and AI reel credits (Custom AI mode). Limits are listed on the pricing page.
• Subscription credits (Starter, Pro) reset monthly and do not roll over.
• PAYG pack credits stack on purchase and expire 90 days after purchase unless otherwise stated on the pricing page.

4. Acceptable Use

You agree not to use MonstaReel to create content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains misinformation, deepfakes, or impersonation of real people
• Promotes violence, hatred, or discrimination
• Violates the terms of any platform you post to (TikTok, Instagram, YouTube, etc.)
• Is used for spam, scams, or fraudulent purposes

We reserve the right to terminate accounts that violate these terms without refund.

5. Intellectual Property

You own the videos you generate using MonstaReel. By generating content, you grant us a limited license to store and deliver your videos via our infrastructure.

The MonstaReel platform, brand, and underlying technology remain our intellectual property. You may not reverse-engineer, resell, or white-label the Service without a written agreement.

6. Payments and Refunds

• Subscriptions are billed monthly or annually in advance.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period — no partial refunds for unused time.
• If you experience a technical failure that prevents reel generation (our fault), contact support within 7 days for a credit refund.
• Chargebacks without contacting support first may result in account suspension.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses caused by downtime, AI service outages (ElevenLabs, Anthropic), or delays in video generation.

8. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied. We do not warrant that AI-generated content will be accurate, original, or suitable for any particular purpose. You are responsible for reviewing content before publishing.

9. Limitation of Liability

To the maximum extent permitted by law, MonstaReel's liability for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Changes to Terms

We may update these terms at any time. We will notify you of material changes via email or in-app notice with at least 14 days notice. Continued use after the effective date constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions.
